MyStreet Terms of Use and Subscription Terms

1. Operator, scope and agreement
MyStreet operates under the trading name Stack Applications, ABN 90 200 899 631 ("MyStreet", "we", "us" or "our").

These Terms explain the use of MyStreet's website, apps and alert services. An alert or subscription agreement is formed when you expressly accept the applicable Terms and request the service, and we confirm activation. Viewing a page or entering an address does not by itself enrol you in a paid subscription.
The plan and price shown and accepted at checkout form part of the agreement. Any specific checkout term must be clearly presented before purchase. Nothing in these Terms removes a right or remedy that cannot lawfully be excluded.
2. What MyStreet does
MyStreet makes selected publicly available planning information easier to search and provides monitoring and notification features for locations you choose. Features, coverage, channels and limits are described on the relevant product and signup screens.
MyStreet is an independent service. It is not a council, the NSW Government, the NSW Planning Portal, a consent authority or an official notification service. Access to a public data feed does not mean government endorsement or certification of MyStreet.
We do not lodge, assess, approve, refuse or stop development applications. MyStreet does not make submissions or objections for you unless a separately described service expressly provides this and you authorise it. A message sent to MyStreet is not a submission to a council or planning authority.
Features marked “coming soon”, including any future postal-letter service, are not included as currently available features. Joining a waitlist does not purchase that feature. A postal or gift service will require its own delivery, recipient-information and purchase disclosures before orders open.
3. Planning information and its limitations
We obtain planning information from sources such as NSW Planning Portal datasets and relevant official records. We may normalise fields, group application types, calculate distances and display source information in a simplified form.
The records available through MyStreet depend on the upstream datasets, their coverage and our successful imports. There can be delays, omissions, corrections, duplicate source records, missing documents or inaccurate coordinates. Historical coverage can differ between councils and periods. A blank search result does not establish that no development is proposed or occurring.
The NSW Online DA dataset is described by its publisher as updated daily. MyStreet may check for changes more frequently, but those checks do not make the underlying source real time. Where displayed, “last checked”, “last imported” and the source record's update date describe different events and must not be treated as the same thing.
A DA feed is not a register of every type of building work. Exempt or complying development, major projects and other approval pathways may not appear unless a relevant additional source is specifically included. MyStreet does not guarantee an alert before works begin, before a decision, or before a consultation deadline.
Check the official application and relevant authority before acting on a deadline, a property transaction, a planning issue or another important decision. This describes the purpose and limitations of the service; it does not remove our duty to provide it with reasonable care and skill or your applicable consumer rights.
4. Status labels, distances and proximity notices
Status labels describe the planning record available to us. “Determined” means a decision has been made; it does not by itself mean approved. A modification application or a request to vary a planning standard does not, by itself, establish unlawful or improper conduct.
Map locations and radiuses are approximate geographic calculations. Distances are generally straight-line distances between mapped points, not walking distance, surveyed boundary measurements or an assessment of the nearest construction activity. A development may cover multiple lots or buildings.
Where MyStreet uses proximity categories, colours or alert priorities, they describe the configured distance or notification rule only. They are not an assessment of danger, legality, building safety, amenity impact, property value, or the likelihood of approval. A nearby minor alteration may have less impact than a larger development farther away.
5. Setting up and receiving alerts
You choose an address or location, a supported radius and the available delivery channels. Where offered, a radius can be selected between 50 metres and 5 kilometres. The radius and filters actually saved control the matching rules; the interface must show them before activation.
Free email alerts can be set up without a password-based account. We may verify the email address before activating delivery. SMS requires a verified number and an enabled, eligible feature. Push notifications depend on device permission and a valid device registration.
You are responsible for checking the selected address, map point, radius and contact details, and for keeping those settings current. You may monitor a property that interests you without owning it; this does not authorise misuse of another person's identity or contact information.
Alerts are based on relevant new or updated records detected after activation. We do not automatically send every historical application as a new alert. A newly discovered record may describe an application lodged earlier, and should be presented that way. Changing a radius can change which applications match.
Delivery can be affected by upstream publication, scheduled processing, network or provider outages, spam filtering, device settings and invalid contact details. We take reasonable steps to operate the alert service reliably but do not promise that every message will arrive or that every nearby proposal will be captured. MyStreet is not an emergency-warning service.
6. Accounts and acceptable use
Provide accurate information and use contact details you control or are authorised to use. Keep passwords, verification codes and management links secure. Tell us promptly if you suspect unauthorised use.
You must not use MyStreet to harass or intimidate anyone, make unlawful threats, impersonate another person or an authority, interfere with systems, bypass access controls, expose another user's private information, or sign other people up to unwanted messages.
Do not use automated requests in a way that disrupts the service or bypasses stated technical limits. This restriction does not remove any independent rights you have to use openly licensed planning information obtained lawfully from its source.
Paid subscriptions must be purchased by someone aged 18 or over. A parent or guardian who wishes to purchase access for a younger person must subscribe in their own name and accept responsibility for the purchase. We do not require people to prove property ownership to use public planning search.
7. Free features, paid features and limits
Free and paid features are identified before signup or purchase. Subscribing to free email alerts does not require purchasing Pro or accepting unrelated marketing.
A paid fee is for MyStreet's product features, monitoring or delivery service, not a government fee or payment for a right to participate in the planning process. The underlying official information may be available independently without paying MyStreet.
Included locations, channels, message allowances and any other material limits must be shown before purchase. We will not describe a capped service as unlimited. No paid overage or additional charge applies without your express agreement. A feature marked unavailable or coming soon must not be sold as currently operational.
8. Subscription prices and renewal
The standard Australian Pro plans, where offered, are:

Prices shown to Australian consumers include GST where applicable and any mandatory charges. A localised app-store price or a clearly disclosed offer may differ; the amount, billing interval and renewal terms shown and accepted in the actual purchase flow govern that purchase.
The annual plan is billed yearly, not in monthly instalments. Any monthly-equivalent figure is an illustration only. At the prices above, 12 monthly payments total A$47.88; the annual plan is approximately 60% less for the same 12-month comparison period, excluding promotional offers.
By expressly subscribing, you authorise the disclosed recurring charge through the selected provider until cancellation. We confirm the selected plan, amount, billing frequency and applicable trial or renewal information. Choosing a plan on the page alone does not authorise payment.
9. Annual free trial
Where offered, an eligible annual subscriber receives three days of access without a subscription fee. A payment method may be required, and any temporary verification authorisation must be disclosed by the payment provider. The checkout confirmation identifies when the trial ends and the first charge is due.
Unless you cancel by the applicable deadline, the trial converts into the annual subscription and the full annual price is charged automatically. At the standard Australian price, this is A$18.99 for the next 12 months, renewing yearly until cancelled.
The standard monthly plan has no free trial and is charged when purchased. Trial eligibility must be checked; it is not guaranteed merely because the trial button appears in a design. Unless a different offer is clearly stated, the standard annual trial is available once per eligible customer. App-store purchases are also subject to the store's introductory-offer eligibility rules.
For a website purchase, cancel before the trial expiry shown in your confirmation to avoid the first subscription charge. For an Apple App Store free trial, Apple's guidance is to cancel at least 24 hours before the trial ends. Other stores' applicable timing and cancellation instructions will be shown for their purchases.
Any trial reminder is an additional help, not a substitute for clear upfront disclosure or for a properly functioning cancellation method. If a store ends trial access immediately after cancellation, its applicable rules govern that access.
10. Cancellation and account deletion
Website subscriptions: Cancel renewal through the subscription-management control provided by MyStreet, including an appropriate secure link for a password-free subscriber. Cancellation must not require creating an unrelated account, making a phone call, or paying a cancellation fee. If the control fails, contact Admin@stackstore.org promptly; we will assist and correct charges attributable to our failure to process a valid, timely request.
App-store subscriptions: Manage and cancel through the store where you purchased. MyStreet provides the relevant management instructions. Store billing processes do not take away any consumer rights you may have against MyStreet.
Cancellation ordinarily prevents the next renewal, with paid access continuing until the end of the period already paid for. Trial access is subject to section 9. We confirm cancellation of a website subscription and its effective end date.
Deleting the app, stopping push notifications, removing a monitored location or unsubscribing from emails does not by itself cancel a paid subscription. Those controls must clearly distinguish stopping messages from stopping billing.
When you request deletion of a MyStreet account, we provide a way to stop future website-subscription renewal as part of the process. An app-store subscription may need to be cancelled separately in the store, and we explain that before deletion. We do not require you to keep an account open until a prepaid period ends in order to request deletion.
11. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies rights or remedies under the Australian Consumer Law or another law where they cannot lawfully be excluded, restricted or modified.
Depending on the circumstances, a service failure may entitle you to have the problem remedied, cancel, obtain a refund for an unused portion or reduced value, or recover compensation for reasonably foreseeable loss. The applicable law determines those rights; they are not limited to what an automated billing portal happens to offer.
Outside your statutory rights and any additional refund promise we make, cancelling because you change your mind ordinarily stops renewal rather than creating a proportionate refund for the current period. A quiet period with no matching new development is not, by itself, a service failure if the promised monitoring is operating as described.
Contact Admin@stackstore.org about a billing error, service problem or refund request. For an app-store purchase, its refund process may also be relevant. We will not use the existence of that process to misrepresent or avoid our own legal responsibilities.
If we permanently stop a paid service before your paid period ends, or make a material reduction that we cannot reasonably remedy or maintain for your remaining term, we offer cancellation and an appropriate refund for the unused affected portion, in addition to any other rights you have.
12. Changes to price, plans or these Terms
We do not increase the agreed price for a period you have already paid for. For a proposed future-renewal price increase or another material adverse subscription change, we give at least 30 days' notice before it takes effect and a clear opportunity to cancel before the change. Where an app store requires express approval or additional steps, those also apply.
We may make reasonable changes to free features or to the service for technical, legal, security or operational reasons. We give reasonable notice of material changes where practicable. An urgent security or legal change may require shorter notice, but does not remove applicable refund or cancellation rights.
We do not use a general change clause to remove a core paid feature without the remedy described in section 11. Changes do not retrospectively remove accrued rights or rewrite a dispute that has already arisen. If a change requires fresh agreement, we obtain it rather than relying only on a footer update.
13. Availability and reasonable care
We use reasonable care and skill in providing MyStreet. Maintenance, third-party changes and outages can affect availability. Where possible, previously imported data remains available during an upstream outage, and freshness or interruption information is shown when material to your use.
The service's planning summaries are general information, not legal, surveying, engineering, valuation, financial or town-planning advice. We do not warrant that a proposed development will be approved, refused, built, altered or abandoned, or that an alert predicts an impact on your property.
We do not exclude responsibility merely because a problem involves a third-party supplier. Any claim is assessed under applicable law and these Terms, taking account of the promised service, reasonable care, causation and any contribution by either party. We do not exclude liability for fraud, wilful misconduct or liability that cannot lawfully be excluded.
14. Privacy and communications
Our Privacy Policy explains how we process contact information, monitored addresses, delivery preferences and technical data. It also explains access, correction, deletion and complaint options.
Agreeing to these Terms is not consent to unrelated marketing. Requested development alerts, optional promotions, device permissions and subscription billing have separate controls. We do not make marketing consent a condition of using a free alert feature.
15. Intellectual property and source attribution
MyStreet's branding, interface and original software belong to their respective owners. You may use the service for its offered purposes, but not falsely claim affiliation or ownership of MyStreet's original materials.
Public planning data and third-party materials are not made exclusively owned by MyStreet merely because we display them. Rights in openly licensed information remain governed by its source licence. Nothing in these Terms overrides those rights.

Our Data sources page links to the relevant dataset and licence and explains MyStreet's processing, such as normalisation and calculated distances. This does not imply endorsement by the source agency.
Third-party maps, architectural drawings, photographs and linked documents may have separate terms and rights. A public link does not mean MyStreet can republish every document or image. We retain required map and data credits and link to official material where appropriate.
16. Suspension and ending the service
We may restrict access where reasonably necessary to address a serious security risk, unlawful conduct, material misuse, non-payment or a substantial breach of these Terms. Where practicable and appropriate, we explain the reason and provide a reasonable opportunity to resolve the issue. Immediate action may be required for a serious risk, and some details may be withheld where law or security requires it.
Restrictions must be proportionate. We do not automatically forfeit all prepaid fees for every breach or impose an unrelated penalty. Refunds, cancellations and outstanding payment issues are handled consistently with sections 10 and 11 and applicable law.
You may stop using free features and cancel renewal of a paid subscription at any time using the relevant controls. Necessary payment, privacy, intellectual-property and dispute obligations can continue after access ends.
17. Concerns about a planning record
To report an incorrect, misleading, privacy-sensitive or otherwise concerning record on MyStreet, contact Admin@stackstore.org with its reference and the issue. We review our display and, where appropriate, correct it, temporarily limit it or direct you to the relevant source authority for an authoritative correction.
We do not treat a variation request, proximity alert or unresolved allegation as proof of illegal development. A disclaimer is not a substitute for accurately presenting the source information.
18. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of its courts and tribunals. This does not prevent a consumer from using a court, tribunal, regulator or complaint process available under mandatory law elsewhere.
Please contact Admin@stackstore.org first so that we can try to resolve a problem. This is not a requirement to give up a legal deadline, urgent relief or a right to approach a regulator. There is no compulsory private arbitration or restriction on making a lawful complaint.
If a provision is invalid or unenforceable, it is ineffective to that extent and the remaining provisions continue where they can operate fairly and lawfully. These Terms do not exclude representations, guarantees or remedies that the law requires us to honour.
